Terms and Conditions

Last updated: 2024

These Terms and Conditions ("Terms") govern the provision of services by Nelipe and apply to any business that engages us through our website or by direct communication. By instructing Nelipe to provide services, you agree to be bound by these Terms. Please read them carefully before placing an order.

1. Who We Are

Services on this website are provided by:

These Terms are governed by the law of England and Wales, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory local law provides otherwise.

2. How an Order Is Placed and Confirmed

Enquiries submitted through our website, by email, or by telephone constitute a request for a quotation and do not, by themselves, create a binding contract. A contract between Nelipe and the client is formed only when:

Once both steps above are completed, an order is considered confirmed, and Nelipe will begin services on the agreed start date. Any changes to scope, targets, or deliverables after confirmation must be agreed in writing by both parties.

3. Prices, Payment and What Is Included

Prices for our outsourced cold sales services are set out in the individual proposal or order confirmation issued to each client and may vary depending on scope, campaign duration, and volume of activity requested. Unless stated otherwise in writing:

Late payment may result in suspension of services until outstanding invoices are settled. Nelipe reserves the right to charge statutory interest on overdue invoices in accordance with applicable UK law.

4. Cancellation and Complaints

A confirmed order may be cancelled by either party by giving written notice, subject to any minimum notice period stated in the order confirmation. Where services have already been performed or resources committed prior to cancellation, the client remains liable for payment of work carried out up to the effective cancellation date.

If you are not satisfied with any aspect of our service, please contact us at info@nelipe.click with details of your complaint. We will acknowledge complaints promptly and aim to investigate and respond within a reasonable timeframe. We are committed to resolving complaints fairly and directly with our clients.

5. Limitation of Liability

Nelipe provides outsourced cold sales services using reasonable skill and care but does not guarantee any specific volume of leads, appointments, conversions, or sales outcomes, as these depend on factors outside our control, including market conditions and the client's own products or pricing.

To the fullest extent permitted by law, Nelipe's total liability arising out of or in connection with any order shall not exceed the total fees paid by the client for the services giving rise to the claim in the preceding three months. Nelipe shall not be liable for indirect, consequential, or special losses, including loss of profits, loss of business opportunity, or reputational damage.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited under the law of England and Wales.

6. Cookies

This website uses a single cookie, consent_state, which stores your cookie consent choice for a period of one year. No analytics, tracking, or session cookies are set by this website. Advertising measurement, where applicable, runs only after consent has been given and takes place solely on the order confirmation page.

7. Data Protection

Nelipe processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For details on how we collect, use, and protect personal data, please refer to our separate Privacy Policy. If you have concerns about how your data is handled, you may also contact the Information Commissioner's Office (ICO), the UK's supervisory authority for data protection.

8. Changes to These Terms

Nelipe may update these Terms from time to time to reflect changes in our services or legal requirements. The version published on this website at the time an order is confirmed will apply to that order.
